UPDATE/CLARIFICATION: Federal rights violations case against City of East Grand Forks

Earlier today I published that Federal Judge Donovan Frank ordered Timothy Charles Holmseth v. City of East Grand Forks Et Al. to proceed.

However – my statement was based upon a formal letter I received today from Honorable Frank wherein the judge referred the case to Federal Pro Se project. It read in part: “If you choose not to participate in the program, or a lawyer does not agree to represent you, your case will proceed and you will continue to proceed Pro Se; that is, on your own behalf.

That's pretty cut and dry.

However...

As of today, I have not received a copy of the actual Order that accompanied the aforementioned. It has come to my attention that the Order actually ‘Denied’ the request, but noted the case was being referred for review by a lawyer who may guide me and/or choose to represent me.

I believe the Court sees the merit of the case and if it is re-filed by an attorney it would be accepted.

Federal Judge: Rights violation complaint to proceed against City of East Grand Forks

Minnesota Federal Judge Donovan Frank has allowed a rights violation complaint against the City of East Grand Forks to proceed.

TIMOTHY HOLMSETH V. CIY OF EAST GRAND FORKS ET AL. alleges Lt. Detective Rodney Hajicek, East Grand Forks Police Department, conspired in secret with others to violate the Constitutional rights of Holmseth after Holmseth began assisting the FBI in a child kidnapping investigation.

Email from Hajicek’s personal Gmail account show he was conspiring against Holmseth on his private account and discussing the problem that was being created by the Florida FBI that was acting on information Holmseth obtained during journalistic interviews regarding photos of a kidnapped child.

Holmseth has evidence that a group created and distributed child rape pornography of a missing child named HaLeigh Cummings.

Holmseth contacted the federal court on August 17, 2017, and requested relief, after he (Holmseth) became the target of an organized campaign by an interstate group that announced they are going to continuously file for protective injunctions against Holmseth and his online publications.

On July 24, 2017, Holmseth filed a Motion to Vacate with the Minnesota State Family Court that contains irrefutable evidence that Hajicek secretly conspired with a group that possessed child rape pornography of the missing and endangered child HaLeigh Cummings. 

Honorable Frank has referred Holmseth’s case to the Federal Pro Se project for an attorney. 

Holmseth (me) is hopeful and optimistic a law firm will accept his case.
